1. Acceptance of these terms
These Terms and Conditions (“Terms”) govern your use of the website https://bigwatermark.com and the BigWatermark watermarking tool (together, the “Service”), operated by BigWatermark (“we”, “us”, “our”). By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
2. The Service
BigWatermark lets you add text or image watermarks to PDF files and images, extract files from ZIP archives, convert Word documents to PDF, and download the results. The Service is provided free of charge. We may add, change or remove features, or suspend the Service, at any time and without notice.
3. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service. If you use the Service on behalf of an organization, you confirm that you are authorized to accept these Terms on its behalf.
4. Your files and content
- You keep all rights to the files you watermark and to your watermark text and images. We do not claim any ownership of them.
- PDFs and images are processed in your browser and are not uploaded to us. Word documents are processed on our servers solely to convert them to PDF for you and are deleted immediately afterwards, as described in the Privacy Policy. You grant us only the limited permission necessary to perform that conversion.
- You are solely responsible for your files and watermarks, and you confirm that you have all rights and permissions needed to modify and watermark them.
- Always keep copies of your original files. The Service creates new watermarked copies, and we cannot recover files for you.
5. Acceptable use
You agree not to use the Service to:
- process content that is unlawful, or that infringes anyone’s intellectual property, privacy or other rights;
- falsely claim ownership of another person’s work, for example by watermarking images or documents you do not own;
- create forged, fraudulent or misleading documents, or misuse official seals, logos or trademarks;
- upload malware or files designed to exploit, damage or interfere with our systems;
- overload, disrupt or attack the Service, circumvent rate limits or security measures, or access it with automated scripts or bots other than standard search-engine crawlers;
- use the Word conversion endpoint as a general-purpose conversion API for other applications;
- copy, resell or redistribute the Service itself, or reverse engineer it except as permitted by law.
We may block access for anyone who violates these rules.
6. Intellectual property
The Service — including its design, text, guides, graphics, logo and the name “BigWatermark” — is owned by us or our licensors and protected by intellectual-property laws. You may use the Service for personal and commercial watermarking purposes, but you may not copy or republish our website content without permission. Open-source components are used under their respective licenses.
7. Advertising and third-party links
The Service may display advertisements and contain links to third-party websites. We do not control and are not responsible for third-party content, products or services, and your dealings with advertisers are solely between you and them.
8. Disclaimer of warranties
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure, or that output files will meet your requirements. A watermark is a visual deterrent and does not guarantee protection against copying, removal or misuse. See also our Disclaimer.
9. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, files, profits, revenue or goodwill, arising from or related to your use of, or inability to use, the Service. Because the Service is free, our total liability for any claim relating to the Service is limited to USD 50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you; nothing in these Terms limits liability that cannot be limited by law.
10. Indemnification
You agree to indemnify and hold harmless BigWatermark and its operators from any claims, damages, losses and expenses (including reasonable legal fees) arising from your files, your watermarks, your use of the Service or your violation of these Terms or of anyone’s rights.
11. Termination
You may stop using the Service at any time. We may suspend or terminate access to the Service for anyone, at any time, for any reason, including violation of these Terms. Sections that by their nature should survive termination will survive.
12. Governing law
These Terms are governed by the laws of the jurisdiction in which the operator of BigWatermark is established, without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of any mandatory consumer laws of your country of residence. Before starting any formal dispute, please contact us so we can try to resolve the issue informally.
13. General
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy, Cookie Policy and Disclaimer, are the entire agreement between you and us regarding the Service.
14. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date shows the latest revision. Continued use of the Service after changes take effect means you accept the updated Terms.
